The Tuscany Region has approved a new Unified Tourism Code that introduces significant changes to the management of short-term rentals, aiming to promote more sustainable tourism. New short-term rental activities will require obtaining a municipal authorization valid for five years for each apartment designated for this use. It’s important to note that the provision is not retroactive; thus, existing activities will not be immediately affected.

Powers of Municipalities

Municipalities will have the authority to establish specific regulations based on defined criteria, which may include:

  • Territorial and Temporal Limitations: The possibility to ban rentals in specific areas or set a maximum number of annual days, even non-consecutive, after which the activity is prohibited.

  • Surface-to-Guest Ratio: Determining the maximum number of guests allowed in a residence based on its size.

  • Quality Standards: Requirements for access to spaces, hygiene, decor, and services offered, such as connectivity.

Furthermore, municipalities may establish a maximum number of authorizations per individual and impose limits on authorizations in specific areas to prevent saturation in regions already densely populated by tourist rentals.

Exceptions

It will always be allowed, without the need for municipal authorizations, to rent a portion of the house where the landlord resides, as well as renting out a single room in the same apartment.

Reactions and Debate

These new provisions have sparked mixed reactions. On one hand, the Florence municipal administration has welcomed the measures, seeing them as a step toward more sustainable tourism management. On the other hand, right-wing representatives have strongly criticized the rules, considering them restrictive and potentially unconstitutional.
